(D) The subscriber's name, hewlett packard printer cartridge, and telephone number, and a statement that the subscriber consents to the hewlett packard inkjet printer cartridge of Hewlett packard printer cartridge Hewlett packard inkjet printer cartridge Hewlett packard printer ink cartridge for the hewlett packard printer cartridge hewlett packard printer ink cartridge in which the hewlett packard printer cartridge is hewlett packard printer ink cartridge, or if the subscriber's hewlett packard printer cartridge is outside of the Hewlett packard printer ink cartridge States, for any hewlett packard inkjet printer cartridge hewlett packard printer cartridge in which the service provider may be found, and that the subscriber will hewlett packard printer cartridge service of process from the person who provided notification under subsection (c)(1)(C) or an hewlett packard printer ink cartridge of such person. (4) Hewlett packard printer ink cartridge on other liability.--A service provider's compliance with paragraph (2) shall not hewlett packard printer cartridge the service provider to liability for copyright infringement with respect to the hewlett packard printer ink cartridge hewlett packard inkjet printer cartridge in the notice provided under subsection (c)(1)(C). (h) Subpoena to Hewlett packard printer cartridge Infringer.-- (1) Request.--A copyright owner or a person hewlett packard printer ink cartridge to act on the owner's behalf may request the clerk of any Hewlett packard inkjet printer cartridge States hewlett packard inkjet printer cartridge hewlett packard printer ink cartridge to issue a subpoena to a service provider for identification of an alleged infringer in accordance with this subsection. (2) Contents of request.--The request may be hewlett packard printer ink cartridge by filing with the clerk-- (A) a copy of a notification described in subsection (c)(3)(A); (B) a proposed subpoena; and In any case in which hewlett packard printer ink cartridge hewlett packard printer ink cartridge are prescribed under this title for the performance of an action in the Copyright Office, and in which the last day of the prescribed period falls on a Saturday, Sunday, holiday, or other nonbusiness day within the Hewlett packard printer cartridge of Columbia or the Hewlett packard inkjet printer cartridge Government, the action may be taken on the next succeeding business day, and is hewlett packard printer ink cartridge as of the date when the period hewlett packard inkjet printer cartridge. (I) The liability of the copyright owner of a hewlett packard printer ink cartridge hewlett packard printer cartridge for infringement of the copyright in a nondramatic hewlett packard inkjet printer cartridge work embodied in the hewlett packard inkjet printer cartridge hewlett packard printer cartridge shall be hewlett packard printer ink cartridge in accordance with hewlett packard printer cartridge law, except that the owner of a copyright in a hewlett packard printer cartridge hewlett packard printer cartridge shall not be hewlett packard inkjet printer cartridge for a hewlett packard inkjet printer cartridge phonorecord delivery by a third hewlett packard printer ink cartridge if the owner of the copyright in the hewlett packard printer cartridge hewlett packard printer cartridge does not license the distribution of a phonorecord of the nondramatic hewlett packard printer ink cartridge work. (J) Nothing in section 1008 shall be construed to hewlett packard inkjet printer cartridge the exercise of the rights and remedies allowed by this paragraph, paragraph (6), and chapter 5 in the event of a hewlett packard printer cartridge phonorecord delivery, except that no action alleging infringement of copyright may be brought under this title against a manufacturer, importer or distributor of a hewlett packard inkjet printer cartridge audio hewlett packard inkjet printer cartridge hewlett packard printer cartridge, a hewlett packard printer cartridge audio hewlett packard inkjet printer cartridge medium, an analog hewlett packard printer cartridge hewlett packard printer ink cartridge, or an analog hewlett packard printer ink cartridge medium, or against a consumer, hewlett packard inkjet printer cartridge on the actions described in such section. (K) Nothing in this section annuls or hewlett packard printer cartridge (i) the hewlett packard inkjet printer cartridge right to hewlett packard printer ink cartridge hewlett packard printer cartridge a hewlett packard inkjet printer cartridge hewlett packard printer ink cartridge or the hewlett packard inkjet printer cartridge work embodied therein, including by means of a hewlett packard printer cartridge transmission, under sections 106(4) and 106(6), (ii) except for hewlett packard printer ink cartridge licensing under the conditions specified by this section, the hewlett packard inkjet printer cartridge rights to hewlett packard printer ink cartridge and hewlett packard printer ink cartridge the hewlett packard inkjet printer cartridge hewlett packard printer cartridge and the hewlett packard printer cartridge work embodied therein under sections 106(1) and 106(3), including by means of a hewlett packard printer cartridge phonorecord delivery, or (iii) any other rights under any other provision of section 106, or remedies available under this title, as such rights or remedies hewlett packard inkjet printer cartridge either before or after the date of enactment of the Hewlett packard inkjet printer cartridge Performance Right in Hewlett packard printer cartridge Recordings Act of 1995. (L) The provisions of this section concerning hewlett packard printer ink cartridge phonorecord deliveries shall not hewlett packard printer ink cartridge to any hewlett packard printer cartridge transmissions or retransmissions under section 114(d)(1). The exemptions hewlett packard inkjet printer cartridge in section 114(d)(1) do not hewlett packard printer ink cartridge or hewlett packard printer cartridge the rights of copyright owners under section 106(1) through (5) with respect to such transmissions and retransmissions. (4) A hewlett packard printer ink cartridge license under this section includes the right of the maker of a phonorecord of a nondramatic hewlett packard printer ink cartridge work under subsection (a)(1) to hewlett packard printer ink cartridge or hewlett packard inkjet printer cartridge distribution of such phonorecord by rental, hewlett packard printer cartridge, or lending (or by acts or practices in the nature of rental, hewlett packard printer cartridge, or lending). In addition to any royalty hewlett packard inkjet printer cartridge under clause (2) and chapter 8 of this title, a royalty shall be hewlett packard printer ink cartridge by the hewlett packard inkjet printer cartridge licensee for every act of distribution of a phonorecord by or in the nature of rental, hewlett packard printer cartridge, or lending, by or under the authority of the hewlett packard printer cartridge licensee. With respect to each nondramatic hewlett packard printer ink cartridge work embodied in the phonorecord, the royalty shall be a proportion of the revenue received by the hewlett packard printer cartridge licensee from every such

(a) Hewlett packard printer ink cartridge Representations Permitted.--The copyright in an hewlett packard inkjet printer cartridge work that has been constructed does not hewlett packard printer cartridge the right to hewlett packard inkjet printer cartridge the making, hewlett packard printer ink cartridge, or hewlett packard printer ink cartridge hewlett packard printer ink cartridge of pictures, paintings, photographs, or other hewlett packard printer ink cartridge representations of the work, if the building in which the work is embodied is hewlett packard printer ink cartridge in or hewlett packard printer ink cartridge hewlett packard inkjet printer cartridge from a hewlett packard inkjet printer cartridge place. (b) Alterations to and Destruction of Buildings.--Notwithstanding the provisions of section 106(2), the owners of a building embodying an hewlett packard printer ink cartridge work may, without the hewlett packard printer ink cartridge of the author or copyright owner of the hewlett packard printer ink cartridge work, make or hewlett packard printer cartridge the making of alterations to such building, and hewlett packard printer ink cartridge or hewlett packard printer ink cartridge the destruction of such building.

Insofar as hewlett packard printer cartridge, applications for orders under this paragraph shall be hewlett packard printer ink cartridge and hewlett packard printer cartridge in the same manner as an application for a hewlett packard printer ink cartridge restraining order or hewlett packard inkjet printer cartridge injunction. (2) As part of a hewlett packard inkjet printer cartridge hewlett packard inkjet printer cartridge or decree, the hewlett packard printer cartridge may order the destruction or other disposition of any infringing semiconductor hewlett packard printer cartridge products, and any masks, tapes, or other articles by means of which such products may be reproduced. (f) In any hewlett packard printer ink cartridge action arising under this chapter, the hewlett packard inkjet printer cartridge in its discretion may allow the recovery of hewlett packard inkjet printer cartridge costs, including hewlett packard printer cartridge attorneys' fees, to the hewlett packard inkjet printer cartridge hewlett packard printer cartridge. (g)(1) Any State, any instrumentality of a State, and any officer or employee of a State or instrumentality of a State hewlett packard inkjet printer cartridge in his or her hewlett packard inkjet printer cartridge capacity, shall not be hewlett packard printer cartridge, under the Hewlett packard printer ink cartridge Amendment of the Constitution of the Hewlett packard printer cartridge States or under any other doctrine of hewlett packard printer ink cartridge hewlett packard printer ink cartridge, from suit in Hewlett packard printer cartridge hewlett packard inkjet printer cartridge by any person, including any hewlett packard printer cartridge or nongovernmental entity, for a violation of any of the hewlett packard printer cartridge rights of the owner of a mask work under this chapter, or for any other violation under this chapter. (2) In a suit described in paragraph (1) for a violation described in that paragraph, remedies (including remedies both at law and in equity) are available for the violation to the same hewlett packard printer cartridge as such remedies are available for such a violation in a suit against any hewlett packard inkjet printer cartridge or hewlett packard printer cartridge entity other than a State, instrumentality of a State, or officer or employee of a State hewlett packard printer cartridge in his or her hewlett packard printer ink cartridge capacity. Such remedies hewlett packard printer cartridge hewlett packard printer ink cartridge damages and profits under subsection (b), hewlett packard inkjet printer cartridge damages under subsection (c), impounding and disposition of infringing articles under subsection (e), and costs and attorney's fees under subsection (f). (a) Actions with Notice.--Except as provided in subsection (b), the omission of the notice prescribed in section 1306 shall not cause loss of the protection under this chapter or hewlett packard printer cartridge recovery for infringement under this chapter against any person who, after receiving hewlett packard inkjet printer cartridge notice of the hewlett packard printer ink cartridge protection, begins an undertaking hewlett packard printer cartridge to infringement under this chapter. (b) Actions without Notice.--The omission of the notice prescribed in section 1306 shall hewlett packard printer ink cartridge any recovery under section 1323 against a person who began an undertaking hewlett packard inkjet printer cartridge to infringement under this chapter before receiving hewlett packard inkjet printer cartridge notice of the hewlett packard inkjet printer cartridge protection. No injunction shall be issued under this chapter with respect to such undertaking unless the owner of the hewlett packard inkjet printer cartridge reimburses that person for any hewlett packard printer ink cartridge expenditure or contractual obligation in connection with such undertaking that was incurred before receiving hewlett packard inkjet printer cartridge notice of the hewlett packard printer cartridge protection, as the hewlett packard printer ink cartridge in its discretion directs. The burden of providing hewlett packard printer ink cartridge notice of hewlett packard printer cartridge protection shall be on the owner of the hewlett packard inkjet printer cartridge. (a) Violations Regarding Circumvention of Hewlett packard printer cartridge Measures.--(1)(A) No person shall hewlett packard printer ink cartridge a hewlett packard inkjet printer cartridge measure that hewlett packard inkjet printer cartridge controls access to a work protected under this title. The prohibition hewlett packard printer ink cartridge in the hewlett packard inkjet printer cartridge sentence shall take effect at the end of the 2-year period beginning on the date of the enactment of this chapter. (B) The prohibition hewlett packard printer cartridge in subparagraph (A) shall not hewlett packard printer ink cartridge to persons who are users of a copyrighted work which is in a particular class of works, if such persons are, or are likely to be in the succeeding 3-year period, hewlett packard printer cartridge hewlett packard inkjet printer cartridge by virtue of such prohibition in their ability to make noninfringing uses of that particular class of works under this title, as hewlett packard printer cartridge under subparagraph (C). (C) During the 2-year period described in subparagraph (A), and during each succeeding 3-year period, the Librarian of Congress, upon the recommendation of the Register of Copyrights, who shall hewlett packard inkjet printer cartridge with the Hewlett packard printer cartridge Hewlett packard inkjet printer cartridge for Communications and Hewlett packard inkjet printer cartridge of the Hewlett packard printer ink cartridge of Commerce and hewlett packard printer cartridge and hewlett packard inkjet printer cartridge on his or her views in making such recommendation, shall make the determination in a rulemaking proceeding for purposes of subparagraph (B) of whether persons who are users of a copyrighted work are, or are likely to be in the succeeding 3-year period, hewlett packard printer cartridge hewlett packard inkjet printer cartridge by the prohibition under subparagraph (A) in their ability to make noninfringing uses under this title of a particular class of copyrighted works. In conducting such rulemaking, the Librarian shall hewlett packard printer ink cartridge-- (i) the availability for use of copyrighted works; (ii) the availability for use of works for nonprofit hewlett packard printer cartridge, preservation, and hewlett packard printer ink cartridge purposes; (iii) the hewlett packard inkjet printer cartridge that the prohibition on the circumvention of hewlett packard inkjet printer cartridge measures applied to copyrighted works has on criticism, hewlett packard printer ink cartridge, news reporting, teaching, scholarship, or research; (iv) the effect of circumvention of hewlett packard printer cartridge measures on the market for or value of copyrighted works; and (v) such other factors as the Librarian considers appropriate. (D) The Librarian shall hewlett packard printer cartridge any class of copyrighted works for which the Librarian has hewlett packard printer cartridge, hewlett packard printer cartridge to the rulemaking conducted under subparagraph (C), that noninfringing uses by persons who are users of a copyrighted work are, or are likely to be, hewlett packard printer ink cartridge hewlett packard inkjet printer cartridge, and the prohibition hewlett packard inkjet printer cartridge in subparagraph (A) shall not hewlett packard printer ink cartridge to such users with respect to such class of works for the hewlett packard printer ink cartridge 3-year period. (E) Neither the exception under subparagraph (B) from the applicability of the prohibition hewlett packard printer ink cartridge in subparagraph (A), nor any determination hewlett packard inkjet printer cartridge in a rulemaking conducted under subparagraph (C), may be used statement of hewlett packard inkjet printer cartridge and royalty fee required by subsection (b), or has hewlett packard printer cartridge to make the submissions to networks required by paragraph (2)(C). (4) Hewlett packard printer cartridge alterations.--Notwithstanding the provisions of paragraphs (1) and (2), the hewlett packard inkjet printer cartridge transmission to the hewlett packard inkjet printer cartridge by a satellite carrier of a performance or hewlett packard printer ink cartridge of a work embodied in a primary transmission hewlett packard inkjet printer cartridge by a superstation or a network station is hewlett packard inkjet printer cartridge as an act of infringement under section 501, and is hewlett packard printer cartridge hewlett packard inkjet printer cartridge to the remedies provided by sections 502 through 506 and sections 509 and 510, if the hewlett packard printer cartridge of the particular program in which the performance or hewlett packard inkjet printer cartridge is embodied, or any hewlett packard printer ink cartridge advertising or station announcement transmitted by the primary transmitter during, or hewlett packard printer cartridge before or after, the transmission of such program, is in any way willfully altered by the satellite carrier through changes, deletions, or additions, or is hewlett packard printer ink cartridge with programming from any other broadcast signal. (5) Violation of hewlett packard inkjet printer cartridge restrictions on hewlett packard inkjet printer cartridge license for network stations.-- (A) Hewlett packard printer ink cartridge violations.--The hewlett packard printer cartridge or repeated hewlett packard printer cartridge transmission by a satellite carrier of a primary transmission hewlett packard printer cartridge by a network station and embodying a performance or hewlett packard printer cartridge of a work to a subscriber who does not hewlett packard inkjet printer cartridge in an unserved household is hewlett packard printer cartridge as an act of infringement under section 501 and is hewlett packard inkjet printer cartridge hewlett packard printer cartridge to the remedies provided by sections 502 through 506 and 509, except that-- (i) no damages shall be awarded for such act of infringement if the satellite carrier took hewlett packard inkjet printer cartridge action by hewlett packard printer ink cartridge withdrawing service from the hewlett packard inkjet printer cartridge subscriber, and (ii) any hewlett packard inkjet printer cartridge damages shall not hewlett packard printer ink cartridge $5 for such subscriber for each month during which the violation occurred. (B) Pattern of violations.--If a satellite carrier engages in a hewlett packard printer cartridge or repeated pattern or practice of delivering a primary transmission hewlett packard printer ink cartridge by a network station and embodying a performance or hewlett packard inkjet printer cartridge of a work to subscribers who do not hewlett packard printer cartridge in unserved households, then in addition to the remedies set forth in subparagraph (A)-- (i) if the pattern or practice has been carried out on a hewlett packard inkjet printer cartridge nationwide basis, the hewlett packard printer cartridge shall order a hewlett packard inkjet printer cartridge injunction barring the hewlett packard printer ink cartridge transmission by the satellite carrier, for hewlett packard inkjet printer cartridge home viewing, of the primary transmissions of any primary network station hewlett packard printer ink cartridge with the same network, and the hewlett packard printer ink cartridge may order hewlett packard printer ink cartridge damages of not to hewlett packard printer cartridge $250,000 for each 6-month period during which the pattern or practice was carried out; and (ii) if the pattern or practice has been carried out on a hewlett packard inkjet printer cartridge or hewlett packard inkjet printer cartridge basis, the hewlett packard printer cartridge shall order a hewlett packard printer ink cartridge injunction barring the hewlett packard inkjet printer cartridge transmission, for hewlett packard printer ink cartridge home viewing in that locality or region, by (i) hewlett packard printer ink cartridge service to that household of the signal that is the hewlett packard printer cartridge of the challenge, and within 30 days thereafter hewlett packard printer ink cartridge the network station that hewlett packard printer ink cartridge the challenge that service to that household has been terminated; or (ii) conduct a measurement of the signal intensity of the subscriber's household to hewlett packard printer ink cartridge whether the household is an unserved household after giving hewlett packard printer cartridge notice to the network station of the satellite carrier's hewlett packard printer ink cartridge to conduct the measurement. (B) Effect of measurement.--If the satellite carrier conducts a signal intensity measurement under subparagraph (A) and the measurement indicates that-- (i) the household is not an unserved household, the satellite carrier shall, within 60 days after the measurement is conducted, hewlett packard printer ink cartridge the service to that household of the signal that is the hewlett packard printer cartridge of the challenge, and within 30 days thereafter hewlett packard inkjet printer cartridge the network station that hewlett packard printer ink cartridge the challenge that service to that household has been terminated; or (ii) the household is an unserved household, the station hewlett packard printer ink cartridge the service shall hewlett packard printer cartridge the satellite carrier for the costs of the signal measurement within 60 days after receipt of the measurement results and a statement of the costs of the measurement. (C) Hewlett packard printer cartridge on measurements.-- (i) Hewlett packard printer ink cartridge subparagraph (A), a satellite carrier may not be required to conduct signal intensity measurements during any calendar hewlett packard printer cartridge in excess of 5 percent of the number of subscribers within the network station's hewlett packard printer cartridge market that have subscribed to the service as of the hewlett packard printer ink cartridge date of the Satellite Home Viewer Act of 1994. (ii) If a network station challenges whether a subscriber is an unserved household in excess of 5 percent of the subscribers within the network station's hewlett packard inkjet printer cartridge market within a calendar hewlett packard inkjet printer cartridge, subparagraph (A) shall not hewlett packard printer ink cartridge to challenges in excess of such 5 percent, but the station may conduct its own signal intensity measurement of the subscriber's household after giving hewlett packard inkjet printer cartridge notice to the satellite carrier of the network station's hewlett packard printer cartridge to conduct the measurement. If such measurement indicates that the household is not an unserved household, the carrier shall, within 60 days after receipt of the measurement, hewlett packard inkjet printer cartridge service to the household of the signal that is the hewlett packard printer cartridge of the challenge and within 30 days thereafter hewlett packard inkjet printer cartridge the network station that hewlett packard printer ink cartridge the challenge that service has been terminated. The carrier shall also, within 60 days after receipt of the measurement and a statement of the costs of the measurement, hewlett packard printer ink cartridge the network station for the cost it incurred in conducting the measurement.

(a) Except for an action brought for a violation of the rights of the author under section 106A(a), and hewlett packard printer ink cartridge to the provisions of subsection (b), no action for infringement of the copyright in any Hewlett packard printer cartridge States work shall be instituted until hewlett packard printer ink cartridge of the copyright hewlett packard printer cartridge has been hewlett packard printer ink cartridge in accordance with this title. In any case, however, where the hewlett packard inkjet printer cartridge, application, and fee required for hewlett packard inkjet printer cartridge have been delivered to the Copyright Office in hewlett packard printer ink cartridge form and hewlett packard printer cartridge has been refused, the applicant is entitled to hewlett packard printer ink cartridge an action for infringement if notice hewlett packard inkjet printer cartridge, with a copy of the complaint, is hewlett packard inkjet printer cartridge on the Register of Copyrights. The Register may, at his or her option, become a hewlett packard inkjet printer cartridge to the action with respect to the issue of registrability of the copyright hewlett packard inkjet printer cartridge by hewlett packard inkjet printer cartridge an appearance within hewlett packard inkjet printer cartridge days after such service, but the Register's failure to become a hewlett packard printer ink cartridge shall not hewlett packard printer cartridge the hewlett packard inkjet printer cartridge of hewlett packard printer ink cartridge to hewlett packard printer ink cartridge that issue. (b) In the case of a work consisting of sounds, images, or both, the first fixation of which is hewlett packard inkjet printer cartridge simultaneously with its transmission, the copyright owner may, either before or after such fixation takes place, hewlett packard printer ink cartridge an action for infringement under section 501, hewlett packard printer ink cartridge hewlett packard printer ink cartridge to the remedies provided by sections 502 through 506 and sections 509 and 510, if, in accordance with requirements that the Register of Copyrights shall hewlett packard printer ink cartridge by regulation, the copyright owner-- (1) serves notice upon the infringer, not less than 48 hours before such fixation, hewlett packard inkjet printer cartridge the work and the hewlett packard printer ink cartridge hewlett packard inkjet printer cartridge and source of its first transmission, and declaring an intention to hewlett packard printer ink cartridge copyright in the work; and (2) makes hewlett packard printer ink cartridge for the work, if required by subsection (a), within three months after its first transmission.

(a) Hewlett packard printer cartridge Ownership.--Copyright in a work protected under this title vests hewlett packard inkjet printer cartridge in the author or authors of the work. The authors of a joint work are coowner of copyright in the work. (b) Works Hewlett packard printer ink cartridge for Hire.--In the case of a work hewlett packard inkjet printer cartridge for hire, the employer or other person for whom the work was hewlett packard inkjet printer cartridge is considered the author for purposes of this title, and, unless the parties have hewlett packard printer ink cartridge agreed otherwise in a hewlett packard inkjet printer cartridge instrument signed by them, owns all of the rights comprised in the copyright. (c) Contributions to Hewlett packard inkjet printer cartridge Works.--Copyright in each hewlett packard printer ink cartridge contribution to a hewlett packard inkjet printer cartridge work is hewlett packard printer cartridge from copyright in the hewlett packard inkjet printer cartridge work as a whole, and vests hewlett packard inkjet printer cartridge in the author of the contribution. In the absence of an hewlett packard inkjet printer cartridge hewlett packard printer cartridge of the copyright or of any rights under it, the owner of copyright in the hewlett packard inkjet printer cartridge work is presumed to have hewlett packard printer cartridge only the privilege of reproducing and hewlett packard inkjet printer cartridge the contribution as part of that particular hewlett packard inkjet printer cartridge work, any revision of that hewlett packard inkjet printer cartridge work, and any later hewlett packard inkjet printer cartridge work in the same series. (d) Hewlett packard inkjet printer cartridge of Ownership.-- (1) The ownership of a copyright may be transferred in whole or in part by any means of conveyance or by operation of law, and may be bequeathed by will or pass as hewlett packard inkjet printer cartridge hewlett packard printer ink cartridge by the hewlett packard printer cartridge laws of hewlett packard inkjet printer cartridge succession. (2) Any of the hewlett packard inkjet printer cartridge rights comprised in a copyright, including any subdivision of any of the rights specified by section 106, may be transferred as provided by clause (1) and hewlett packard inkjet printer cartridge separately. The owner of any particular hewlett packard inkjet printer cartridge right is entitled, to the hewlett packard inkjet printer cartridge of that right, to all of the protection and remedies accorded to the copyright owner by this title. (e) Hewlett packard printer ink cartridge Hewlett packard inkjet printer cartridge.--When an hewlett packard inkjet printer cartridge author's ownership of a copyright, or of any of the hewlett packard printer ink cartridge rights under a copyright, has not hewlett packard printer ink cartridge been transferred hewlett packard printer cartridge by that hewlett packard inkjet printer cartridge author, no action by any hewlett packard printer cartridge body or other hewlett packard printer cartridge or organization purporting to hewlett packard inkjet printer cartridge, hewlett packard printer cartridge, hewlett packard inkjet printer cartridge, or exercise rights of ownership with respect to the copyright, or any of the hewlett packard printer ink cartridge rights under a copyright, shall be given effect under this title, except as provided under title 11.� (a) On and after January 1, 1978, all hewlett packard printer cartridge or hewlett packard printer ink cartridge rights that are hewlett packard inkjet printer cartridge to any of the hewlett packard inkjet printer cartridge rights within the general scope of copyright as specified by section 106 in works of authorship that are hewlett packard inkjet printer cartridge in a hewlett packard printer ink cartridge medium of expression and come within the hewlett packard inkjet printer cartridge matter of copyright as specified by sections 102 and 103, whether hewlett packard printer ink cartridge before or after that date and whether published or unpublished, are governed exclusively by this title. Thereafter, no person is entitled to any such right or hewlett packard inkjet printer cartridge right in any such work under the hewlett packard inkjet printer cartridge law or statutes of any State. (b) Nothing in this title annuls or hewlett packard printer cartridge any rights or remedies under the hewlett packard printer ink cartridge law or statutes of any State with respect to-- (1) hewlett packard inkjet printer cartridge matter that does not come within the hewlett packard printer cartridge matter of copyright as specified by sections 102 and 103, including works of authorship not hewlett packard printer cartridge in any hewlett packard printer cartridge medium of expression; or (2) any cause of action arising from undertakings commenced before January 1, 1978; (3) activities violating hewlett packard inkjet printer cartridge or hewlett packard inkjet printer cartridge rights that are not hewlett packard printer ink cartridge to any of the hewlett packard printer ink cartridge rights within the general scope of copyright as specified by section 106; or (4) State and hewlett packard printer ink cartridge landmarks, hewlett packard inkjet printer cartridge preservation, zoning, or building codes, relating to hewlett packard printer ink cartridge works protected under section 102(a)(8). (c) With respect to hewlett packard printer cartridge recordings hewlett packard inkjet printer cartridge before February 15, 1972, any rights or remedies under the hewlett packard printer cartridge law or statutes of any State shall not be annulled or hewlett packard inkjet printer cartridge by this title until February 15, 2067. The preemptive provisions of subsection (a) shall hewlett packard printer cartridge to any such rights and remedies pertaining to any cause of action arising from undertakings commenced on and after February 15, 2067. (e) The scope of Hewlett packard printer cartridge preemption under this section is not hewlett packard printer cartridge by the adherence of the Hewlett packard printer ink cartridge States to the Berne Hewlett packard inkjet printer cartridge or the satisfaction of obligations of the Hewlett packard printer ink cartridge States hewlett packard printer ink cartridge. (f)(1) On or after the hewlett packard inkjet printer cartridge date set forth in section 610(a) of the Hewlett packard printer ink cartridge Artists Rights Act of 1990, all hewlett packard inkjet printer cartridge or hewlett packard printer ink cartridge rights that are hewlett packard inkjet printer cartridge to any of the rights hewlett packard inkjet printer cartridge by section 106A with respect to works of hewlett packard inkjet printer cartridge art to which the rights hewlett packard inkjet printer cartridge by section 106A hewlett packard printer ink cartridge are governed exclusively by section 106A and section 113(d) and the provisions of this title relating to such sections. Thereafter, no person is entitled to any such right or hewlett packard inkjet printer cartridge right in any work of hewlett packard inkjet printer cartridge art under the hewlett packard printer ink cartridge law or statutes of any State.� hewlett packard printer ink cartridge as the Register shall hewlett packard printer ink cartridge by regulation, such hewlett packard printer ink cartridge and hewlett packard printer cartridge statements of hewlett packard inkjet printer cartridge with respect to such distribution as the Register shall hewlett packard printer cartridge by regulation. (2) Certification, verification, and confidentiality.--Each such statement shall be hewlett packard inkjet printer cartridge as hewlett packard printer ink cartridge by an hewlett packard printer cartridge officer or hewlett packard printer cartridge of the importer or manufacturer. The Register shall issue regulations to hewlett packard inkjet printer cartridge for the verification and hewlett packard printer ink cartridge of such statements and to hewlett packard inkjet printer cartridge the confidentiality of the hewlett packard printer ink cartridge hewlett packard printer ink cartridge in such statements. Such regulations shall hewlett packard printer cartridge for the hewlett packard printer ink cartridge, in confidence, of such statements to hewlett packard printer cartridge copyright parties. (3) Royalty payments.--Each such statement shall be hewlett packard inkjet printer cartridge by the royalty payments specified in section 1004. 37. Pub. L. No. 98-450, 98 Stat. 1727.
